Abolition of RPGT

i. the RPGT abolition will be gazetted on 1.4.2007; ii. Effective 1.4.2007, sellers/disposers and buyers/acquirers will no longer need to file CKHT 1 and 2 forms; iii. the RPGT abolition will apply to all disposals including by individuals and companies; iv. if a sale and purchase agreement (SPA) is dated prior to 1.4.2007, the seller/disposer and buyer/acquirer will have to file CKHT 1 and 2 forms, but if dated after 1.4.2007 then they need not file CKHT 1 and 2 forms. It depends on the date of the SPA and not on the completion date; and v. if a property is disposed prior to 1.4.2007 then the seller/disposer must declare any gain in his personal income tax returns. On the other hand, if it is disposed after 1.4.2007, then there is no need to declare any gain in the personal income tax returns.

By KEITH HIEW PETALING JAYA: Prime Minister Datuk Seri Abdullah Ahmad Badawi, who announced the scrapping of the real property gains tax (RPGT) from April 1, hopes the move would “inject more excitement and dynamism to both the property and financial sectors.” Speaking at Invest Malaysia 2007 yesterday, Abdullah said the abolishment of RPGT would improve the property sector. He said it was among the immediate measures intended to further increase and facilitate investments in the country. Property companies and analysts welcomed the news. They said it would benefit the sector, especially the high-end segment. OSK Securities analyst Mervin Chow told StarBiz: “We will definitely see an increase in the earnings prospects of property companies, either through an increase in demand or sales values.
